Dutch Supreme Court Rejects Labrokes Appeal

Dutch Supreme Court Rejects Labrokes De Lotto Appeal

On 18 February 2005 the Dutch Supreme court ruled in the Ladbrokes summary proceedings and rejected the appeal lodged against a September 2003 decision that recognized the exclusive right of the Dutch betting operator De Lotto

With this decision a process of more than 2 years seems to have ended. The debate, however, may still go on for a number of reasons.

♠ In the first place, the Dutch Supreme Court does not answer the most important question: can the imposed requirements be reconciled with European law, notably with the Gambelli and Lindman judgments of the European Court of Justice. An answer to that question shall most likely be given in the ongoing main proceedings.

♠ Secondly and in relation hereto, it should be noted that while the gaming restrictions were upheld in summary proceedings, the situation in the main proceedings is different, if not opposite. In its interlocutory judgement of 2 June 2004, the lower court of Arnhem requested a proof of a consistent gaming policy and preliminary concluded that the imposed restrictions did not meet the requirements of European law. A final decision in these main proceedings is expected for April 2005.

♠ Thirdly, it is unclear how this decision articulates with the above mentioned June 2004 decision of the Court of Arnhem and the outcome of the main proceedings. Even though the decision of the Supreme court has more "authority", it must be stressed that it is only taken in the summary proceedings. Furthermore and seen the apparent contradiction, it might be more likely that the Court of Arnhem brings the case before the European Court of Justice. As the Tribunale di Larino in the Italian Placanica case, the Dutch Court in the main proceedings may be confused by the he difference between the interpretation emerging from the decisions of the European Court of Justice, notably the Gambelli judgment, and the jurisprudence of its Supreme Court. For this reason and to know how it should apply the Gambelli requirements, it can bring the case before the ECJ and request for a clarification.

♠ In the fourth place, the decision self can be commented form a European Internal Market perspective.

In absence of any Community rule in the field of gaming, the Supreme Court holds that the case should only be considered under Dutch law. As Dutch residents can online access and participate in games organised by Ladbrokes without many difficulties, Dutch law applies.

By stating so the Dutch Supreme Court does not consider the de facto cross-border character of internet and their European dimension. The fact that the gaming platform is hosted and operated in another Member State is not very relevant. It is clear that this conflicts with statements made by the European Commission and a landmark decision of the Finish Court of Appeals of Turku.

In accordance with the Directive on electronic commerce and the decision of the Landgericht M�nchen I of 27 October 2003, the Turku Court held in its decision of 31 March 2003 that the organization of gaming services is exclusively subject to the laws of the place of establishment (Country of Origin). As the Internal Market principle of the Directive on electronic commerce and the proposal for a Service Directive, a gaming operator should only comply with the law of its Country of Origin and cannot be submitted to additional requirements for the cross-border provision and promotion of its services.

For this reason, authorities of Finland, or the Netherlands, cannot impose additional requirements or conditions to, e.g., a Malta based and licensed remote gaming operator.

Furthermore, the Supreme Court seems to ignore the ECJ Lindman judgment of 13 November 2003. In Lindman, the ECJ obliged the Member states to prove, with statistical or other evidence, that the imposed restrictions meet the requirements of European law and thus that the underlying reasons are clear and present. The Dutch Supreme Court holds that a theoretical abstract threat for consumers and of money laundering is sufficient to override the freedom to provide services throughout the European Union.

Eventually and in relation to the Community rules, reference can be made to the opinion of Advocate General Gulmann in the Schindler case. Gulmann held that by virtue of the principle of equivalence, the Member State of destination may not impose additional restrictions to the cross-border provision of services if those services are already subject to the adequate rules of the home state. Recognising the necessity to limit the overall supply of gaming services and in absence of any Community rules in this field, restrictive measures necessarily had to be taken by each Member State separately. A contrario, this implies that when European rules in the field of gaming and associated services would be adopted, e.g., via the proposal for a Service Directive, the arguments evoked by Member States to justify the restrictive measures, notably the protection of society at large, would lose their relevance.

In this view and with a possible ECJ referral in the main proceedings, the gaming issue can again be brought on the European agenda. With the new Placanica case already pending before the European Court, 2005 seems to become a very important year for the European remote gaming industry. Not only is there the European Commission?s study on gambling, the second review of the electronic commerce Directive, but also the famous Service Directive will be debated in the European Parliament. Eventually, one may not forget that it is very likely that regulatory models adopted by the United Kingdom, Malta and Slovakia will lead to serious internal market distortions, underlying the need of a European initiative in the field of remote gaming and associated services.

Mike Dean was booked to referee the Newcastle V Bolton game today, but has been suspended indefinately until the racing and betting scandal investigation is completed.

GAMblog comment :: Hot on the heels of the German Football Betting Scandal and not to mention the less notoroius Czech Football Betting Scandal I think a story with an English referee involved in another betting scandal is unfortunate timing.

The News Of The World uncovered the story which detracts weight from the story, not adds to it heheh.. Will just have to wait and see what Mike Dean has been up to, if anything. It's not like Referee Mike Dean's Contact Page tries to hide his involvemnt in the Arbotros Racing horseracing syndicate. Quite the contrary. Mike Dean signs off and leaves his email with his proper name there.

Malcolm Glazier continues his attempt to take over Man Utd and will stop until he gets his way, that is obvious.

That said, the Independent Manchester United Supporters Association will not be giving up just yet.

Later today there will be a plane flying over Man Utd's Old Trafford with a Stop Malcom Glazier banner flowing in the wind. I have no idea who will be paying for the stunt.

The Man Utd fans had better hope it is not snowing a blizzard and indeed is a nice fine clear day. Otherwise we won't be able to see the banner down here in London and everywhere else in the world apart from in Manchester.

It has to be said that most of the Man Utd fans only dream of being in Manchester on a freezing cold saturday afternoon, in the middle of an English winter. They may dream of being in Manchester on days like this, but would not dream of actually going to Old Trafford.

Czech Betting Scandal

Czech Football Betting and Bribery Scandal

The German football betting and match fixing scandal is all the rage.

Something is amiss elsewhere in Europe, but reports on what FC Slovan Liberic have been up to are thin on the ground for English speakers who don't understand Czech. Slovan Liberec lose points for scandal is a fair line into what has been going on within Czech Football but accurate reports are sketchy.

Buried half way down the page and entitled an innoccuos looking headline of "Bad Taste", you can peruse some information regarding police wiretaps that revealed an agreement between Gambrinus liga club officials and referees to fix games and you know what ~ I am still none the wiser as to the why's and wherefores of the Czech football betting and match fixing scandal.

I need input here. Shall keep an eye out for Czech betting scandal news. Post some in the comments if you find it to be relevant.

World Snooker Endurance Record Holder Breaker Paul Morgan

Something different from the snooker world aside Ronnie O'Sullivan kicking everyones ass and Jimmy White calling himself James Brown for a hot minute, so he can advertise for HP Sauce.

The World Endurance Snooker Record has been broken by amatuer snooker player Paul Morgan after he played 300 consecitive frames of snooker in 73 straight hours.

The Guiness book of world records states that the snooker player can have a 5 minute break every hour but Paul Morgan played snooker for a straight 24 hours without a break atall, eating and drinking while playing snooker all the while. I guess he stopped at 24 hours for an ablution break heheh.

In the first day, Paul made 5 century breaks with a top score of 132. As the days went by Paul got tired and scored less heavily, understandably so.

The first frame of snooker in the endurance test was against comedian Bernard Manning in front of the tv cameras to kick off the event, which was for charity. The Christie Hospital In Manchester was the recipient of the charty fundraiser by Paul Morgan, so far £3000 has been raised and hope to raise up to 5 or maybe £10 thousand.

Paul Morgan was a professional snooker player for 3 years in the late 90's and used to practise with Jimmy "whirlwind" White and Alex "hurricane" Higgins. Paul has represented England in snooker aswell. Paul Morgan's snooker career claim to fame was once beating a 16 year old Ronnie O'Sullivan 3-2 at a London venue.

Paul Morgan now just potters around the amatuer scene nowadays playing snooker here and there for fun. Of course, that is inbetween breaking World Snooker Endurance Records

Bernard Hopkins remains the undisputed middleweight champion of the world after retaining all 4 belts against the flambouyant Howard Eastman in Los Angeles about an hour ago.

It was live on the Beeb - which was nice for non Sky boxing fans.

Of course, Eastman fought well. He always does. Seemingly destined to fall short when up against the big boys on the big day though, Eastman looked good enough to win to me. Something is not right about that guy. Maybe his eccentricity is his strength and his weakness.

Once again, the talented "Eastman gets beat in a world title fight on points", he could or should have won.

I gather the Poker Room software giant Prima Poker will be introducing some kind of high tech update scheduled for the end of March 2005.

What the Prima software March update will entail is not public knowledge and won't be until Prima unveil it, but I hear it will be good. I suppose it will, who knows. Anyway...

# Gamblog is not a word and it means nothing to the search engines. I appreciate the links as a vote of confidence but the word gamblog means nothing and you might aswell link with the words "yoghurt knitting". gamBlog.co.uk has taken a dive in the search engines and no one one new seems to come here anymore. I could do with a kick in the right direction please.

The World Endurance Snooker Record has been broken by amatuer snooker player Paul Morgan after he played 300 consecitive frames of snooker in 73 straight hours.

The Guiness book of world records states that the snooker player can have a 5 minute break every hour but Paul Morgan played snooker for a straight 24 hours without a break atall, eating and drinking while playing snooker all the while. I guess he stopped at 24 hours for an ablution break heheh.

In the first day, Paul made 5 century breaks with a top score of 132. As the days went by Paul got tired and scored less heavily, understandably so.

The first frame of snooker in the endurance test was against comedian Bernard Manning in front of the tv cameras to kick off the event, which was for charity. The Christie Hospital In Manchester was the recipient of the charty fundraiser by Paul Morgan, so far £3000 has been raised and hope to raise up to 5 or maybe £10 thousand.

Paul Morgan was a professional snooker player for 3 years in the late 90's and used to practise with Jimmy "whirlwind" White and Alex "hurricane" Higgins. Paul has represented England in snooker aswell. Paul Morgan's snooker career claim to fame was once beating a 16 year old Ronnie O'Sullivan 3-2 at a London venue.

Paul Morgan now just potters around the amatuer scene nowadays playing snooker here and there for fun. Of course, that is inbetween breaking World Snooker Endurance Records

It did the rounds for a while. Some punters got on the reality tv betting bandwagon by betting on when and if anyone will have sex live on the Big Brother reality tv show.

Last time up, before the Celebrity Big Brother show went out, there was Michelle "chicky" Bass and Stuart "stewie" Wilson doing the swallow under the table. According to blogger Gavin, the admittance by Michelle Bass that she gave Stuart Wilson a blowjob and swallow while on the Big Brother show, albeit not visible to the general public, has prompted bookies to payout the "will anyone have sex live on the Big Brother show" betting market.

A commenter at Gavins Blog begged the question whether Michelles admittance of giving Stuart a blowjob, actually consists a good enough reason for the bookies to pay out on the Big Brother sex market. Likened to and very nicely worded, the commenter used the word "Lewinskyesque" heheh.

So now you know. I have no reason to doubt Gavin. If I find out the sex on Big Brother show betting market is still open, which I can find no trace of at the bookies at the moment, I will post the odds here.

Hopkins Beats Eastman On Points

Bernard Hopkins remains the undisputed middleweight champion of the world after retaining all 4 belts against the flambouyant Howard Eastman in Los Angeles about an hour ago.

It was live on the Beeb - which was nice for non Sky boxing fans.

Of course, Eastman fought well. He always does. Seemingly destined to fall short when up against the big boys on the big day though, Eastman looked good enough to win to me. Something is not right about that guy. Maybe his eccentricity is his strength and his weakness.

Once again, the talented "Eastman gets beat in a world title fight on points", he could or should have won.

I gather the Poker Room software giant Prima Poker will be introducing some kind of high tech update scheduled for the end of March 2005.

UK Arcade Amusements Change Lady Robbed By Mr Spotty

When you go into a UK amusements arcade you get your change for your notes and get robbed by the 75% payout fruit machines and 10p pushers.

Mr Spotty does not agree.

Some spotty boy robber asked the change lady in the Sunset Amusements on Southgate in Elland for change of a tenner, then he and his friend asked the change lady for help with a fruit machine. When she came out of the change box, Mr Spotty stuck a knife up to the arcade lady and robbed her of a few quid.

Graham Lee has double prospects on Boys Hurrah (4.00), successful in both his starts at Sandown, and Oneway (1.40), who bids to complete a five-timer in the two-mile chase. Mark Rimell's rapidly improving eight-year-old showed his best effort when scoring over course and distance last month, and could still be one step ahead of the handicapper.

Liberman will be all the rage should he take his chance in the Sandown Hurdle (3.25) after the form of his Market Rasen win over Patriarch Express was boosted by the latter's victory at Cheltenham last Saturday. The former Cheltenham Festival bumper winner did not take to hurdling initially, but should be followed now the penny has dropped, although he will not be much of a price.

At longer odds, Touch Closer makes each-way appeal after splitting a useful pair at Warwick last time out.

Chelsea are now a best priced 1/9 for the Premiership, after Arsenal effectively kissed goodbye to their championship hopes midweek, leaving them 10-points adrift of the leaders, third behind United.

The Reds can be backed at 4/7 to see off their fierce rivals in our seasonal match bet, which is effectively a bet on which team will finish second.

Chelsea could go further clear when they play Blackburn on Wednesday night, and can expect another 3-pointer when they play Man City at home on Sunday (live on SS1, ko 16.05). The 90-mins price (1/4) is unattractive, however, so the best way to make money on the game is to have a bet on the home-home double result at 8/13, or on them keeping their eighth consecutive clean sheet in the Premiership at 8/11. A more speculative wager is Lampard to score first, Chelsea 3 0, scorecast at 35/1. Once the game kicks off, take your pick from our 12 In-Play markets. challenge.

The Emerald Islanders were second in the competition last year,
after an impressive campaign which included a 19-13 victory over England
at Twickenham. Since then, they have continued to build on that triumph with

advantage of playing both of their main rivals inside the sanctuary of
Lansdowne Road, which must give them a massive chance.

Well Chief put up an excellent weight-carrying performance in last Saturday's Victor Chandler chase, and this rising star is now a 5/2 shot for the Champion Chase. He won decisively and on merit, and it would be no surprise to see him topple Moscow Flyer and Azertyuiop at Cheltenham next month. On a day of Cheltenham clues, another prospective Festival winner emerged in the shape of Akilak, who ran out an easy winner of the Juvenile Hurdle, and is now an 8/1 favourite for the Triumph.

For the same race, keep an eye out for Martin Pipe's Windyx, a springer in the market at 40/1, ahead of his expected hurdling debut in the next couple of weeks. Grey Abbey was an impressive winner of the Pillar Chase, and has been chopped in to 10/1 for the Gold Cup. He could be hard to beat there if allowed his own way up front.

Finally, make a note of Palarshan, who was spotted staying on up the hill behind Saturday's winner Buckby Lane, on ground that would have been softer than ideal. Best on good fast ground in the spring, he could be an ideal candidate for the Mildmay of Flete Handicap.
